The Department of Transportation's (DOT) rule, 49 CFR Part 40, describes required procedures for conducting workplace drug and alcohol testing for the Federally regulated transportation industry. 

 

Any employee who performs safety sensitive functions mandated by the DOT is required to comply with the drug and alcohol testing regulations specified in 49 CFR Part 40. When an employee has violated these regulations, the employee must complete the DOT Return-to-Duty process with a Substance Abuse Professional (SAP) before he or she can again perform any DOT safety-sensitive duties for any employer.

The Department of Transportation (DOT) regulation 49 CFR Part 40 defines the Substance Abuse Professional (SAP) as a person who evaluates employees who have violated a DOT drug and alcohol regulation and makes recommendations concerning education, treatment, follow-up testing, and aftercare. In order for one to be a SAP, that person must have certain credentials, possess specific knowledge, receive training, and achieve a passing score on a DOT examination. There is also a continuing education requirement.

Substance Abuse Professional (SAP) 

Per the US Department of Transportation, a SAP is the advocate for neither the employer nor the employee. The SAP's function is to protect the public interest in safety by professionally evaluating the employee and recommending appropriate education and/or treatment, follow-up tests, and aftercare.
